Throughout these Terms & Conditions (“Terms”), the terms “FreeWink,” “we,” “us,” and “our” refer to HONG KONG NEWBEST TRADING LIMITED.
Our store is powered by Shopify.
By accessing our website, purchasing a product, creating an account, communicating with us, or otherwise using our website and related services (collectively, the “Services”), you agree to these Terms.
If you do not agree to these Terms, you should not use the Services.
1. ELIGIBILITY AND USE OF THE SERVICES
By using the Services, you represent that you are legally capable of entering into a binding agreement in your jurisdiction or are using the Services with the authorization of a person who has such legal capacity.
You may not use the Services for unlawful, fraudulent, abusive, or unauthorized purposes.
You must not interfere with the security, integrity, performance, or operation of our website or attempt to gain unauthorized access to our systems or customer information.
2. PRODUCT INFORMATION
We make reasonable efforts to provide accurate descriptions, specifications, images, dimensions, colors, features, pricing, and other information concerning our products.
Actual appearance may vary slightly depending on lighting, photography, screen settings, manufacturing tolerances, product revisions, or other reasonable factors.
Product performance, including travel range, speed, charging time, climbing performance, and battery life, may vary depending on factors including rider weight, terrain, temperature, battery condition, riding style, tire condition, speed, incline, and other operating conditions.
You are responsible for reviewing the product specifications, dimensions, intended use, user manual, and safety information before use.
3. MOBILITY AND SAFETY INFORMATION
FreeWink products include mobility scooters, powered mobility products, walkers, wheelchairs, and related equipment.
You must use products in accordance with the applicable user manual, safety instructions, operating limitations, and warnings.
Users should consider their own physical condition, balance, judgment, mobility needs, and ability to safely operate the product.
Where appropriate, consult a qualified medical or mobility professional before using a mobility product.
Do not exceed published weight, incline, environmental, charging, or operating limitations.
4. TRAVEL, AIRLINES, CRUISES, AND TRANSPORTATION
Some FreeWink products are designed with travel and portability in mind.
Airline, cruise-line, rail, transit, and other transportation-provider policies can differ and may change.
Customers are responsible for confirming current requirements directly with the relevant transportation provider before traveling, particularly requirements concerning lithium batteries, mobility devices, dimensions, weight, packaging, and advance notification.
A product’s suitability for travel does not guarantee acceptance by every carrier on every route.
5. ORDERS
When you place an order, you agree that the information you provide is current, complete, and accurate.
An order confirmation does not necessarily constitute final acceptance of an order.
We reserve the right, where permitted by applicable law, to reject or cancel an order for legitimate reasons including:
Pricing or listing errors.
Suspected fraud.
Payment authorization problems.
Product unavailability.
Shipping restrictions.
Duplicate or obviously erroneous orders.
Violations of these Terms.
If we cancel an order after receiving payment, we will arrange an appropriate refund.
6. PRICES, PROMOTIONS, AND PAYMENT
Prices are displayed in the currency shown on the website.
The price charged for a product will be the price clearly displayed for that product in the cart and at checkout when the order is placed, subject only to correction of an obvious error as permitted by applicable law.
Any sale price, discount, promotional code, eligibility requirement, start or end date, or other material promotional condition will be disclosed clearly where the promotion is offered. Promotional pricing shown on product pages, collection pages, the cart, and checkout should be consistent for the same offer and customer eligibility.
Applicable taxes and any other charges will be displayed separately at or before checkout where applicable. Free standard shipping is available only as described in our Shipping Policy.
You agree to provide valid payment information and authorize the applicable payment provider to process amounts due for your order.
Prices and promotions may change for future orders, but changes will not retroactively alter an order already accepted by us, except where required to correct an obvious error or as otherwise permitted by applicable law.
7. FINANCING AND INSTALLMENT PAYMENTS
We may make third-party financing or installment-payment options available to eligible customers.
Financing or installment services are provided by independent third-party providers and may be subject to:
Eligibility requirements.
Credit or identity verification.
Separate terms and conditions.
Separate privacy policies.
Payment schedules.
Fees, interest, or other charges disclosed by the provider.
Availability of a financing option on our website does not guarantee approval.
FreeWink does not control the independent approval, credit, or underwriting decisions of third-party financing providers.
Where you use such a service, your financing relationship may also be governed by a separate agreement between you and the financing provider.
8. SHIPPING AND DELIVERY
FreeWink currently provides free standard shipping to eligible physical street addresses within the 48 contiguous United States and Washington, D.C. No minimum order value is required.
We do not currently ship to Alaska, Hawaii, Puerto Rico, U.S. territories, P.O. boxes, APO/FPO/DPO addresses, or destinations outside the United States.
Orders are typically processed within 1–2 business days, Monday through Friday, excluding applicable holidays. Our daily order cutoff time is 2:00 PM Pacific Time.
After processing, estimated carrier transit time is 5–7 business days. The estimated total delivery time is 6–9 business days.
Delivery times are estimates and may be affected by carrier delays, severe weather, holidays, address verification, service interruptions, or other circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address. If an order is returned because an incorrect or incomplete address was provided, additional shipping costs may apply where permitted by law.

9. RETURNS AND REFUNDS
Returns and refunds are governed by our Return & Refund Policy at https://freewink.us/policies/refund-policy, which forms part of these Terms.
Our standard eligible return period is 30 days after receipt, subject to the conditions stated in that policy.
For change-of-mind returns, including where a customer no longer wants the product or ordered the wrong product or model, the customer is responsible for return shipping costs.
Where a return results from a verified product defect, shipping damage, or our fulfillment error, FreeWink will be responsible for reasonable authorized return shipping costs.
Customers must contact us and obtain return instructions before sending a product to a return facility.
10. WARRANTIES
Where a FreeWink product is sold with a stated manufacturer’s or seller’s warranty, the applicable warranty period and coverage are those disclosed on the product page, warranty documentation, or other written materials supplied with the product.
Warranty coverage does not generally extend to damage caused by misuse, abuse, unauthorized modification, accidents, improper charging, improper storage, failure to follow instructions, ordinary wear and tear, or other excluded circumstances stated in the applicable warranty terms.
Nothing in these Terms excludes mandatory consumer rights that cannot legally be excluded or limited.
11. THIRD-PARTY SERVICES AND LINKS
Our Services may contain links to or integrations with independent third parties, including:
Shopify.
Payment processors.
Financing providers.
Shipping and logistics companies.
Social media platforms.
Customer communication platforms.
Analytics and advertising services.
Third-party services may be governed by their own terms and privacy policies.
We are not responsible for the acts, omissions, availability, or independent policies of third parties except to the extent responsibility cannot be excluded under applicable law.
12. INTELLECTUAL PROPERTY
Unless otherwise stated, the content of the FreeWink website, including branding, logos, text, graphics, photographs, product presentations, videos, layouts, and other original content, is owned by or licensed to HONG KONG NEWBEST TRADING LIMITED and is protected by applicable intellectual property laws.
You may use the website for personal, non-commercial shopping purposes.
You may not reproduce, distribute, modify, commercially exploit, scrape, republish, or create derivative works from protected content without authorization, except where permitted by law.
13. REVIEWS, TESTIMONIALS, AND USER CONTENT
If you submit a review, photograph, comment, testimonial, or other content to us, you confirm that you have the right to provide that content and that it reflects your genuine experience and opinions.
You must not submit unlawful, defamatory, fraudulent, infringing, threatening, abusive, fabricated, or misleading content.
FreeWink will not knowingly publish fabricated reviews or testimonials. We will not label a review or testimonial as a "Verified purchase" or make an equivalent claim unless we have a reasonable basis to verify that the reviewer purchased or used the relevant product.
Where legally permitted, you grant us a non-exclusive right to use content voluntarily submitted for publication in connection with operating, improving, and promoting our Services, subject to our Privacy Policy and any applicable permissions.
Submitting content privately for troubleshooting, warranty assistance, or customer support does not automatically give FreeWink permission to publish that content as a review, testimonial, or advertisement.
14. PROHIBITED USES
You may not use our website or Services:
For unlawful or fraudulent purposes.
To infringe intellectual property or privacy rights.
To transmit malicious code.
To interfere with website security.
To collect information about others unlawfully.
To impersonate another person.
To submit false order or payment information.
To engage in abuse, harassment, or other unlawful conduct.
We may restrict access where reasonably necessary to protect customers, the Services, or our legal rights.
15. DISCLAIMER
To the maximum extent permitted by applicable law, the Services and website content are provided on an “as available” basis.
Nothing on the website constitutes medical advice, and product information should not replace advice from an appropriate healthcare or mobility professional where such advice is needed.
Nothing in these Terms excludes warranties, guarantees, remedies, liabilities, or consumer rights that cannot lawfully be excluded.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, HONG KONG NEWBEST TRADING LIMITED will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from use of the website or Services where such liability may lawfully be limited.
This provision does not exclude or restrict liability that cannot be excluded or restricted under applicable law.
17. PRIVACY
Our collection and use of personal information are governed by our Privacy Policy at https://freewink.us/policies/privacy-policy.
By using the Services, you acknowledge that personal information may be processed as described in that Privacy Policy and by applicable third-party service providers.
18. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices, technology, or applicable requirements.
The current version will be posted on this page together with the “Last updated” date.
Changes will not affect rights that have already accrued where applicable law prevents such an effect.
19. SEVERABILITY
If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will remain in effect.
20. NO WAIVER
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
21. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, product-specific terms, and any other policies expressly incorporated by reference, constitute the agreement governing your use of the Services and purchases from FreeWink.
22. GOVERNING LAW, DISPUTE RESOLUTION, ARBITRATION, AND CLASS ACTION WAIVER
22.1 Governing Law
Except as otherwise required by mandatory applicable law, these Terms and any separate agreements through which we provide the Services are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.
Nothing in these Terms limits any mandatory consumer protection right, remedy, or jurisdictional right that cannot lawfully be waived or restricted.
22.2 Informal Dispute Resolution
Before commencing arbitration or other formal proceedings, you and FreeWink agree to make reasonable good-faith efforts to resolve the dispute informally.

The notice should include, where reasonably available:
Your full name;
Your email address;
Your order number, if applicable;
A description of the dispute;
The facts relevant to the dispute; and
The remedy or resolution you are requesting.
FreeWink will make reasonable efforts to review and respond to the dispute.
Unless immediate action is reasonably necessary to preserve a legal right or applicable law requires otherwise, the parties agree to allow at least 30 days after receipt of the written notice to attempt to resolve the dispute informally.
22.3 Binding Arbitration for United States Consumers
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
For customers residing in the United States, except for disputes that qualify for small claims court or disputes that applicable law does not permit to be arbitrated, any dispute, claim, or controversy arising out of or relating to:
These Terms;
Your purchase or use of a FreeWink product;
Your use of freewink.us;
An order, payment, shipment, return, refund, or warranty request;
Communications between you and FreeWink; or
The relationship between you and FreeWink
that cannot be resolved through the informal dispute resolution process described above shall be resolved by binding individual arbitration, rather than in court.
The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with its applicable Consumer Arbitration Rules, as modified by these Terms where legally permitted.
The arbitration agreement contained in this Section 22.3 is intended to involve interstate and international commerce. To the extent applicable, the United States Federal Arbitration Act (“FAA”) will govern the interpretation, enforcement, and validity of this arbitration agreement.
If there is a conflict between these Terms and the AAA Consumer Arbitration Rules concerning the arbitration procedure, the AAA Consumer Arbitration Rules will control to the extent required by applicable law or AAA consumer due-process requirements.
22.4 Arbitration Location and Format
Where permitted under the applicable AAA Consumer Arbitration Rules, arbitration may be conducted:
By telephone;
By video conference;
Through written submissions; or
In person.
If an in-person hearing is required, the location will be determined in accordance with applicable AAA Consumer Arbitration Rules and applicable law, taking into account the consumer's place of residence and the circumstances of the dispute.
Nothing in this section is intended to impose an unreasonable or legally prohibited burden on a consumer seeking to pursue a claim.
22.5 Arbitration Fees
Arbitration filing, administration, and arbitrator fees will be allocated in accordance with the applicable AAA Consumer Arbitration Rules and applicable law.
FreeWink will pay arbitration fees that the applicable AAA Consumer Arbitration Rules or applicable law require the business to pay.
Nothing in these Terms requires a consumer to pay fees or costs that cannot lawfully be imposed on the consumer.
22.6 Small Claims Court
Notwithstanding the arbitration provisions above, either party may bring an eligible individual claim in a small claims court of competent jurisdiction, provided that the claim remains within that court's jurisdiction and proceeds on an individual basis.
22.7 CLASS ACTION AND JURY TRIAL WAIVER
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FREEWINK AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS.
Neither you nor FreeWink will seek to have a dispute heard or resolved as:
A class action;
A representative action;
A collective action;
A consolidated action involving claims of unrelated parties; or
A private attorney general action,
except where such waiver is prohibited by applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FREEWINK ALSO WAIVE THE RIGHT TO A TRIAL BY JURY FOR CLAIMS SUBJECT TO BINDING ARBITRATION UNDER THIS SECTION.
The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim, except where applicable law requires otherwise.
22.8 Right to Opt Out of Arbitration
If you are a United States consumer, you may opt out of the binding arbitration and class action waiver provisions in Sections 22.3 through 22.7 by sending us written notice within 30 days after the date you first become subject to these Terms.

Your request should include:

The email address associated with your purchase or account, if applicable;
Your order number, if applicable; and
A clear statement that you wish to opt out of the FreeWink arbitration agreement.
If you timely and properly opt out, Sections 22.3 through 22.7 will not apply to you. All other provisions of these Terms will continue to apply.
Your decision to opt out of arbitration will not affect your ability to purchase FreeWink products or use our Services.
22.9 Consumers Outside the United States
For consumers outside the United States, and for United States consumers who validly opt out of arbitration, disputes will be subject to the courts and dispute-resolution procedures otherwise available under applicable law.
Subject to mandatory consumer protection rights and jurisdictional rights that may apply to you, the courts of the Hong Kong Special Administrative Region shall have non-exclusive jurisdiction over disputes arising out of or relating to these Terms, the Services, or purchases made through FreeWink.
22.10 Severability
If any portion of this Section 22 is found to be unlawful, invalid, or unenforceable, that portion will be interpreted or severed to the minimum extent necessary, while the remainder of this Section will remain in effect to the fullest extent permitted by applicable law.
Nothing in this Section 22 excludes, limits, or waives any mandatory consumer right or remedy that cannot legally be excluded, limited, or waived.
